These terms and conditions apply to the use of this website www.homeandgardencentre.co.uk and by accessing/purchasing from this website and/or over the telephone you agree to be bound by the terms and conditions set out below. Before you place an order, if you have any questions relating to these terms and conditions, please contact us by email or by using the contact form, and we will be happy to assist you.

We reserve the right to amend the terms and conditions applying to the goods purchased on our website at any time, and any such change will be effective on all orders placed after such terms and conditions have been published on this website. We recommend that you check the terms and conditions occasionally to ensure that you are aware of any changes and comply with the current version.

ORDERING

Making a purchase could not be easier. Just browse our store, and add any items that you wish to buy into the shopping cart. After you have finished your selection, click on 'Checkout' and you will be asked for a few details that we need to be able to complete the order. If you make a mistake with your order and cannot correct it whilst in the shopping cart, contact us and we will assist you. Once completed, we will send you an order confirmation email detailing the products you have ordered, the pricing and the delivery address you have provided. Please check these details to ensure they are correct and contact us straight away if any of it is incorrect.

The order confirmation email is to indicate that we have received your order and it does not indicate that the order has been accepted and that a contract exists between us. The order is only accepted by Home & Garden Centre upon dispatch of the ordered goods. Any products on the same order which we have not despatched do not form part of that contract. We reserve the right not to accept all or part of your order for any reason whatsoever including, but not limited to, payment problems, the unavailability of product or errors in pricing or product descriptions posted on the website.

Every effort is made to show products on the website as accurately as possible and that all products have been fairly described and portrayed. Despite this, slight variations may occur on certain products, these could include, but are not limited to, slight differences in texture, wood finish or colours. We will try to resolve any errors on the website as soon as we can, and if we reasonably think that a mistake on our part has affected your order, we will do our best to offer a solution. We cannot be held liable to you for errors contained on the website.

We ask you to take account of the dimensions of the products, especially on large, heavy items such as indoor/outdoor furniture and BBQs when considering your purchase. It is your responsibility to check carefully that the products you have ordered will fit into your home or garden.

Viewing Orders

You can only view your order on our website if you have registered with us. To view your order simply log in using the link on the top menu, where you will then see all the details of your account including all of your orders.

PAYMENT, PRICING & PROMOTIONS

Payment is taken in full once you have confirmed your order and completed the checkout process. We accept the following credit and UK debit cards: Visa, Mastercard, Delta, Maestro, Solo and Visa Electron. We do not currently accept American Express.

All credit and debit card transactions are subject to validation checks and are authorised by the card issuer. If the issuer of your card refuses to authorise payment to us, we will not be liable for any delay or non-delivery of your order. No orders will be accepted or processed without a valid card payment in the name of the registered cardholder.

All prices include VAT, standard rated items at 20%, zero rated items at 0%. VAT receipts available on request.

There may be a shipping surcharge to deliver large goods (indoor & garden furniture, large BBQs) to the Scottish Highlands, off-shore Islands, Channel Islands and Northern Ireland, even if delivery is stated as free. If a surcharge is required, we'll contact you after an order has been placed, to take surcharge payment if you wish to proceed with your order. We base surcharges on the amount we are charged by our carriers. We send via the cheapest option and our policy is to never profit from a delivery surcharge.

Every effort is made to ensure that prices are accurate on our website and they are checked to the best of our ability. However please note that if a pricing error is noticed before the item is dispatched, we are under no obligation to provide the product at the incorrect price.

Any complimentary gift items offered with a purchase, “gift with purchase”, must be returned in its original condition if you wish to cancel/return the purchased item under our returns policy.

Only one promotional code/promotion can be used per transaction. All offers are subject to stock availability.

We reserve the right to decline to accept orders where, in our reasonable opinion, a promotion code or discount is invalid for the order being placed or is the subject of fraudulent activity.

SHIPPING & DELIVERY

Estimated delivery times are quoted on the product pages for each item. We shall make every effort to fulfil your order by the estimated delivery date provided. However, in rare cases, circumstances beyond our control may prevent us doing so. We will advise you of any delays and do our best to deliver your order as quickly as possible.

Delivery dates do not form any part of the contract with us and no compensation will be offered for late deliveries in any event. If your item has not been dispatched and delivered within 30 days from the date of purchase, you may exercise your right to cancel for a refund.

Some large/heavy items and multiple item orders are supplied on non-returnable wooden pallets. Due to the weight and size of certain products, pallets may need to be used in order to deliver such items safely. It is the customer’s responsibility to dispose of the pallets; we are unable to remove them. A delivery day will be arranged however deliveries cannot be booked in for a specific time slot. 

Following delivery, we highly recommend that any faults, missing items or damages are reported as soon as possible. This may allow us to resolve any issues more swiftly for you. Please retain all packaging until you are happy that there are no faults with your product.

We ship to UK addresses only, however there may be a surcharge to deliver large goods (indoor & garden furniture, large BBQs, items over 20kg) to the Scottish Highlands, off-shore Islands, Channel Islands, remote locations and Northern Ireland, even if delivery is stated as free. If a surcharge is required, we'll contact you after an order has been placed, to take surcharge payment if you wish to proceed with your order. We base surcharges on the amount we are charged by our carriers, we send via the cheapest option and our policy is to never profit from a delivery surcharge. For offshore and overseas deliveries; should you wish to arrange your own shipping agent on the mainland, please contact us for further assistance.

Certain orders may require a signature upon delivery. Should you wish to make a request for orders to be left in a ‘safe place’ with no signature (and it has been agreed with us), we cannot accept liability for items left unsupervised.

If you provide a shipping address relating to a work place or a public place, please note that once the order has been delivered, the responsibility for the product lies with the cardholder and any loss/damage is then at your own risk. Also, a signature of any authorised body is deemed to be proof of delivery.

In the case of a delivery being refused or you are not in at the agreed time at the delivery address, we reserve the right to charge a re-delivery fee. This applies to all indoor furniture orders and orders where a delivery date and time has been specifically arranged with a customer. Please note this can cost up to £60.00 per item/pallet depending on the size and weight, so we highly recommend you contact us at least 48 hours prior to the arranged delivery date if you foresee any potential issues with delivery.

Please note that all garden furniture, large bulky items and pallet deliveries are kerbside only, unless stated otherwise.

Home & Garden Centre uses external delivery companies and we cannot expect delivery drivers to assist with the moving/handling of your item into houses, outbuildings, garages, up multiple steps/stairs etc. When ordering bulky/heavy items, please ensure you have the means to handle these items when delivery is received and that you are able to dispose of the packaging material.

PRODUCT SPECIFIC INFORMATION

National Garden Gift Vouchers:
We use Royal Mail for delivering Gift Vouchers. All National Garden Gift Voucher orders over £30 are sent by Recorded Signed For (up to £100) or Special Delivery Next Day (over £100) and need to be signed for on delivery. Cut off time for next day delivery is 2pm. Any orders placed after 2pm on Friday will be dispatched the following Monday (excluding bank holidays). See our Terms & Conditions for policy on replacement vouchers due to non-delivery. If there is no-one available to sign for the National Garden Gift Voucher(s) on arrival, a card will be left by the postman informing the occupant that an attempted delivery was made. The Gift Vouchers will then be taken to the local Royal Mail Enquiry Office, where they will await collection by the recipient. A suitable form of identification (such as a utilities bill bearing the relevant address) may be required when collecting Gift Vouchers. Should your National Garden Voucher(s) not be collected within 14 days, Royal Mail will return the vouchers to us at which point we will endeavour to contact you to arrange a suitable alternative delivery address and date of delivery. We can deliver to addresses all across the UK including the Channel Islands and Scottish Isles. Despatch of National Garden Gift Vouchers is from mainland UK - please allow extra time for your order to arrive if sending to remote locations, Highlands or offshore locations. Unfortunately we do not deliver anywhere else.

Small Parcels (including wellies, giftware, homeware, lighting, accessories etc.):

  • Please allow 2-3 working days for delivery
  • We use Royal Mail or Parcelforce to deliver small parcels
  • Orders will be delivered Monday- Friday. Any orders placed after 2pm on Friday will be dispatched the following Monday (excluding bank holidays)
  • Once your item has been shipped, you will receive a dispatch email. Please expect delivery to take place 2 working days from receiving this email
  • If you are not in when a delivery attempt is made, you will receive a card detailing what to do next
  •  

    Desser Cane Furniture:

  • Free 2 man specialist delivery only applies to Desser orders over £250
  • Your order will be shipped by a 2-man carrier. The carrier will contact you by phone to confirm the delivery date. On the day of the delivery, the carrier will contact you in the morning to remind you about the delivery and confirm again the approximate delivery time. On arrival, the 2-man delivery crew will carry the product to your room of choice. This includes up to two flights of stairs
  • Allow 4-6 weeks for delivery as the items are made to order
  • Deliveries cannot be left unsigned by driver, or with next door neighbour. So it is extremely important that you arrange with the delivery company a delivery date when you will be there to receive the order
  • In the case of a delivery being refused or you are not in at the agreed time at the delivery address, we reserve the right to charge a re-delivery fee. Please note this can cost up to £60.00 per item/pallet depending on the size and weight, so we highly recommend you contact us at least 48 hours prior to the arranged delivery date if you foresee any potential issues with delivery
  •  

    Barbecues:

  • Estimated delivery times are quoted on the product pages for each item
  • Orders will be delivered Monday- Friday
  • Once your item has been dispatched, you will receive an email containing either the expected delivery date and/or a tracking code
  • If you are not in when a delivery attempt is made, you will receive a card detailing what to do next
  • Deliveries cannot be left unsigned by the driver, or left with a next door neighbour
  • Delivery is kerbside only
  • BBQs over 40kg may be delivered on a non-returnable wooden pallet
  • For orders where a delivery date and time has been pre-arranged with you: In the case of a delivery being refused or you are not in at the agreed time at the delivery address, we reserve the right to charge a re-delivery fee. Please note this can cost up to £60.00 per item/pallet depending on the size and weight, so we highly recommend you contact us at least 48 hours prior to the arranged delivery date if you foresee any potential issues with delivery
  • Some BBQs may attract a surcharge to deliver to the Scottish Highlands, off-shore islands, Channel Islands and Northern Ireland
  •  

    Garden Furniture:

  • Estimated delivery times are quoted on the product pages for each item
  • Once your item has been dispatched, you will receive an email containing either the expected delivery date and/or a tracking code
  • Orders will be delivered Monday- Friday
  • If you are not in when a delivery attempt is made, you will receive a card detailing what to do next
  • Deliveries cannot be left unsigned by the driver, or left with a next door neighbour
  • Delivery is kerbside only
  • Most wooden furniture is delivered flat packed, and will require some simple assembly, allen keys are provided in the packs. Some weave tables also require a small amount of assembly
  • Multiple item orders and large pre-assembled items may be delivered on a non-returnable pallet
  • Some furniture orders may attract a surcharge to deliver to the Scottish Highlands, off-shore Islands, Channel Islands and Northern Ireland.
  •  

    Indoor Furniture:

  • Please allow up to 14 working days for delivery
  • The delivery company will email/text you with a delivery date and time slot. Please ensure you provide the correct contact information. Details will be provided on how you can arrange an alternative date if the date given is unsuitable
  • Deliveries are a “deliver to door” service. For very large items (such as triple wardrobes), the delivery can be made to a “room of your choice”, in which case the driver will require you to sign a damage waiver. This enhanced service would need to be arranged beforehand
  • Some furniture may be delivered flat packed, and will require some simple assembly. If this is the case, we will notify you that “assembly is required” on the product description page
  • Deliveries are to UK mainland only. Certain remote locations may attract a surcharge and we will contact you if this is the case
  • In the case of a delivery being refused or you are not in at the agreed time at the delivery address, we reserve the right to charge a re-delivery fee. Please note this can cost up to £60.00 per item/pallet depending on the size and weight, so we highly recommend you contact us at least 48 hours prior to the arranged delivery date if you foresee any potential issues with delivery
  •  

    Kelkay Bulk Bags:

  • Kelkay products are made up of natural materials so there may be colour and size variation to images shown on our website. Due to limitations in the reprographics process the colour of natural products cannot be guaranteed within our online or paper brochure
  • Deliveries are to UK mainland only
  • Some Scottish postcodes carry a delivery charge supplement per item
  • Delivery will be to nearest kerbside or hard-standing. Ensure that the surface is smooth and level to unload onto
  • Access must be suitable for large lorries with rear tail-lift offload
  • All items are supplied on non-returnable wooden pallets
  • You will be contacted in advance with the date and time of delivery, this will normally take place within 7 days of order being placed. Deliveries must be signed for
  • If an arrangement for delivery is broken, a re-delivery charge will apply and is paid direct to the transport company. In certain cases this charge may be more than the original subsidised delivery charge paid. Please note this can cost up to £80.00, so we highly recommend you contact us or Kelkay directly, at least 48 hours prior to the arranged delivery date if you foresee any potential issues with delivery.

    RETURNS, CANCELLATIONS & REPLACEMENTS

    We want you to be happy with your order, however if you are wanting to cancel your order and return unwanted items, you may notify us within 14 days of delivery. Please email your cancellation/refund request to info@homeandgardencentre.co.uk and include your order number in the email. You will then have another 14 days in which to return the unwanted item back to us.

    If your order has already been dispatched, you will have to cover the cost of returning the product. In most cases we will be able to assist you with this procedure by offering a returns label or arranging a carrier collection (for larger items), however the cost would need to be deducted from your refund amount. We would offer this service when we feel that we can provide a cheaper returns option for you (than you making your own arrangements), as we are able to make use of business rates with the carriers we use. You may arrange your own returns, although we recommend you obtain a certificate of postage and consider insuring the item. As the customer is responsible for the goods until safely delivered back to us.

    An estimate cost of returning goods:
    Items weighing under 3kg: £4.95
    Items weighing up to 30kg: £30
    Items weighing over 30kg: £60
    Kelkay Aggregates Bulk Bags: £80

    Any goods returned must be in a saleable condition, if products are not in a saleable condition you will not be refunded the product retail cost. Saleable condition means brand new, unworn/unused, not altered in any way or washed, and they must be in their original packaging.

    Footwear returned without a box, in a damaged box or with marked soles may not be accepted, and may be sent back to the customer. Please do not write on the shoebox or tape it up; please use suitable packaging, such as a cardboard box, bin/shopping bags, wrapping paper.

    Once the product is back with us and has been checked, we will process the refund due to you as soon as possible, and within 14 days.

    Returning Defective or Damaged Items

    We kindly ask that any defects or damages are reported as soon as possible. Should any items arrive damaged, it is preferable that we are notified within 48 hours, as this may allow us to resolve any issues more swiftly for you.

    Should there be any visible faults/damages, please do not assemble or use the product, if you intend to return it, as this could be deemed as treating the product as your own and therefore accepting the product.

    Please retain the packaging as you may need to return the product in packaging to prevent further damage, if the product is to be returned for a replacement or refund. If products were delivered flat packed they must be returned in the same way including complete disassembly, as carriers will not be able to safely get that item back to us if it is built up.

    We will require photographic evidence of the damage/defect before any replacement or collection can take place. This helps us to get a better understanding of the fault, for evidence which can be supplied to the supplier or manufacturer and to help us identify which replacement part is needed.

    We reserve the right to offer replacement parts or to repair an item. Our policy is to firstly see if a replacement part is available, as this is the quickest way to resolve any issues, and we have found in most cases that it is more convenient for the customer.

    If you return a defective, damaged or incorrect item for a refund, you’ll be refunded for the original postage cost (if the defective product constitutes the entire order), the cost of the item and we will cover the returns postage. We will arrange for the safe return of the item and do not recommend that you make your own arrangements for returning faulty goods. If you make your own arrangements, the cost and method of the return should be agreed with us in advance.

    Please note that these legal rights do not apply if the goods are deemed to have been damaged by wear and tear, an accident or misuse.

    Voucher Non Delivery

    We cannot be held responsible or issue refunds on vouchers lost due to an incorrect address entered when placing an order.
    An order is only considered lost by Royal Mail, 10 working days after dispatch. If an order has been lost or stolen, customers should contact Customer Services. If the order was placed using Royal Mail Special Delivery then replacement vouchers will be issued within 5 working days.
    If a non-delivered order was placed using First Class Post then the below process applies:
    1) Customers must contact Customer Services informing them of non delivery. An investigation will then begin between Customer Services, Royal Mail and our Voucher Department.
    2) If after 5 days, the customer still requires their vouchers, then they will be asked to place another order on the website and we will pay (refund) the delivery charge. If after 30 days we discover that the original vouchers have been lost/stolen, we will issue a full refund up to the value of the original order placed.
    3) If the customer does not require replacement vouchers then we will still need to undergo an investigation with Royal Mail and our Voucher Department. This process may take up to 30 days. If after 30 days we are satisfied that the vouchers have been lost/stolen then we will refund the value of the order.

    Parcels / Bulky Items Non Delivery

    We cannot be held responsible or issue refunds on parcels lost due to an incorrect address entered when placing an order.
    An order is only considered lost by the carrier, 10 working days after dispatch. If an order has been lost or stolen, customers should contact Customer Services. The below process applies:
    1) Customers must contact Customer Services informing them of non delivery. An investigation will then begin between Customer Services and the carrier.
    2) If the customer still requires the item(s), then they will be asked to place another order on the website. If after 30 days we discover that the item(s) have been lost/stolen, we will issue a full refund up to the value of the original order placed.
    3) If the customer does not require a replacement item(s) then we will still need to undergo an investigation with the carrier. This process may take up to 30 days. If after 30 days we are satisfied that the item(s) have been lost/stolen then we will refund the value of the order.

    PRIVACY & SECURITY

    By placing an order on our website you agree to belong to our mailing list. We do not disclose this list to any third parties, and you can request to be removed from our mailing list at any time. The mailing list is used solely to send information about current products, offers, and to help generate feedback to improve our service. Home & Garden Centre do not disclose buyers' information to third parties other than when order details are processed as part of the order fulfilment. In this case, the third party will not disclose any of the details to any other third party. Cookies are used on this shopping site to keep track of the contents of your shopping cart, to store delivery addresses if the address book is used and to store your details if you select the 'Remember Me' Option. They are also used after you have logged on as part of that process. You can turn off cookies within your browser by going to 'Tools | Internet Options | Privacy' (in Internet Explorer) and selecting to block cookies.     We reserve the right at any time to: withdraw or add products to our range, add or remove suppliers from our list, revise prices, change delivery methods or carrier, amend these terms and conditions; and add to or remove payment methods.

    We shall not be responsible for the performance of any obligations which are outside of our reasonable control, including but not limited to, strikes, lock outs, failures of third party systems or networks, acts of god, deliberate sabotage or malicious damage to equipment or data, or for damages to or destruction to premises or equipment.

    Whilst we intend for this website to be available 24 hours a day, we will not be liable if for any reason this website is unavailable at any time or for any period. Access may temporarily be suspended without notice in the case of system failure, maintenance or repair or for reasons beyond our control.

    Any assistance given to the delivery driver i.e. helping lift items off the lorry, is done so at the customer’s discretion and we accept no responsibility for any injury sustained.

    Nothing in the Terms shall exclude or limit our liability for death or personal injury resulting from our negligence.

    If any provision of these Terms is found by a court or regulator to be illegal, unlawful, invalid or unenforceable the other provisions will still be valid and shall continue to apply.

    INTELLECTUAL PROPERTY AND USE OF THE WEBSITE

    You acknowledge and agree that all copyright, database rights, trademarks and all other intellectual property rights in all material or content of this website is owned by Home & Garden Centre. You acknowledge and agree that the material contained in the website is made available for your personal non-commercial use only and that you may print off one copy, and may download extracts of any page(s) from our site for your personal reference onto only one computer hard drive for such purpose.
